OVERVIEW

How the LTB works.

The Landlord and Tenant Board (LTB) is the Ontario tribunal that resolves disputes under the Residential Tenancies Act, 2006. It handles terminations, rent arrears, maintenance complaints, illegal entries, harassment claims, and rent disputes — all without going through Superior Court. Decisions are made by tribunal members; the process is more accessible than court but the deadlines and procedural rules still matter.

Most LTB matters start with a notice (an N-form from a landlord, or a tenant raising a written complaint). If the issue isn't resolved, the next step is an application (L-form for landlords, T-form for tenants) and a hearing. JSR represents both landlords and tenants — every file is handled directly by Jugraj, a paralegal licensed by the Law Society of Ontario.

WHAT WE HANDLE

Each side has its own toolkit of notices and applications. Picking the wrong form or missing a deadline can sink a perfectly good case — we make sure the right paper goes in on time.

Landlord applications

L-forms, N-forms, mediation, hearing, enforcement.

  • L1 — non-payment of rent and termination
  • L2 — termination for other reasons (cause)
  • L3 — failure to meet settlement / mediated order
  • L4 — tenant breach of an LTB order
  • L9 — rent arrears (with the tenant still in possession)
  • L10 — recovery of a previous tenant's debt
  • N4 (arrears), N5 (conduct), N6 (illegal acts), N7 (safety/wilful damage)
  • N8 (persistent late), N12 (landlord/buyer own use), N13 (demolition/repairs)

Tenant applications

T-forms, defences, bad-faith claims, review of order.

  • T1 — return of money paid (e.g. rent paid in cash without receipts)
  • T2 — interference with reasonable enjoyment, harassment, illegal entry
  • T5 — bad faith N12 / N13 — tenant has 1 year to file
  • T6 — maintenance and disrepair claims
  • N9 — tenant's notice of termination
  • N11 — agreement to terminate (both sides sign)
  • Defending L1 / L2 / L4 applications
  • Setting aside default and review of order applications
HOW WE WORK A FILE

From notice to order — and enforcement.

Realistic timeline: notice to hearing typically takes several months in 2026 — LTB wait times remain long. We plan around that.

Matter intake & notice

We confirm the issue (arrears, conduct, maintenance, illegal entry, etc.), pick the right notice form (N4 for arrears, N5 for conduct, etc.), and serve it correctly. Service rules are strict — invalid service is a common reason cases fail.

Application & evidence package

If the notice doesn't resolve the issue, we file the appropriate L or T form via the Tribunals Ontario Portal. Evidence pack includes ledger of payments, communication history, photos, witness statements, and any expert reports.

Mediation / hearing

The LTB often offers mediation before the hearing — a quick way to settle. If mediation fails or isn't suitable, we represent at the hearing: examination, cross-examination, and submissions. Hearings typically run by video; in-person available on request.

Order & enforcement

Once an order issues: monetary orders enforced through Small Claims Court for collection; eviction orders enforced by the Court Enforcement Office (Sheriff) — never by self-help. We also handle reviews of order where there's a real procedural error.

WHAT WE'LL ASK FOR

LTB hearings turn on documentary evidence. We build the evidence pack early so nothing surfaces for the first time at the hearing.

Tenancy paperwork

  • Written lease (or evidence of an oral tenancy)
  • Standard form of lease where applicable (post-April 2018)
  • Rent receipts and ledger of payments
  • Any addendums, riders, side agreements

Landlord side

  • The N-form served (with proof of service)
  • Communication log with the tenant (emails, texts, letters)
  • Photos of the unit and any damage
  • Witness statements from other tenants, contractors, neighbours

Tenant side

  • The N-form received (with date and method of service)
  • Rent payment records (e-transfers, cheque stubs, bank records)
  • Photos of disrepair or interference
  • Medical records where harassment or maintenance affected health

Service & filing proof

  • Certificate of Service for any N-form
  • LTB application filing confirmation
  • Tribunals Ontario Portal account details
  • Any correspondence from the LTB

Enforcement (after order)

  • LTB order being enforced
  • Sheriff filing for eviction enforcement
  • Garnishment / writ for monetary collection
  • Forwarding addresses for absent former tenants

What the LTB charges.

Filing fees are reduced when you file through the Tribunals Ontario Portal. LTB fees are non-refundable, regardless of outcome.

Fee waivers are available in cases of demonstrated financial hardship. LTB filing fees are non-refundable. The Sheriff's enforcement fee (for evictions) is set separately by the Court Enforcement Office.
